Terms of service

These terms and conditions (the "Terms") govern your use of www.tamaragill.com (the "Site") and any purchase you make from it. The Site is owned and operated by Tamara Gill ("we", "us", "our").
By using the Site you confirm that you have read and understood these Terms and agree to them. If you do not agree, please do not use the Site.
Our intellectual property
Everything published on the Site — text, images, cover art, logos, page design and downloadable files — belongs to Tamara Gill or is used under licence. You may not copy, reproduce or republish any of it without our written permission.
The books sold through this Site, including their text, cover art and audio recordings, remain our copyright at all times. Buying a book does not transfer any ownership of the work itself.
Reservation of rights for text and data mining
We expressly reserve all rights in our works, including this Site and every book sold through it, against text and data mining, web scraping, and use in the development or training of artificial intelligence or machine learning systems. This is an express reservation for the purposes of Article 4(3) of Directive (EU) 2019/790 and any equivalent provision in other jurisdictions. No such use is permitted without our prior written consent.
What you may do with the books you buy
Ebooks and audiobooks
When you buy a digital book you are buying a licence to read or listen to it, not the book itself. That licence is personal to you, non-exclusive and non-transferable. You may:
- Download the file to devices you own and read or listen to it as often as you like
- Keep a backup copy for your own use
You may not:
- Sell, lend, gift, sub-licence or otherwise pass the file to anyone else
- Upload it to any website, file-sharing service, cloud library or forum
- Reproduce or distribute it in any format, in whole or in part
- Remove or alter any watermark, copyright notice or identifying information
- Use it for any commercial purpose
Our digital files are supplied without DRM because we would rather trust our readers than restrict them. Please do not share them.
Paperbacks and special editions
You own the physical copy you buy and may resell or give away that copy. You may not reproduce, scan, digitise or redistribute the contents.
Acceptable use
You agree to use the Site lawfully. In particular, you agree not to:
- Infringe our intellectual property rights or those of anyone else
- Act fraudulently, or attempt to use stolen or unauthorised payment details
- Copy content from the Site
- Interfere with the operation or security of the Site, or attempt to gain unauthorised access to it
- Use automated tools to scrape, harvest or mine content from the Site
If we reasonably believe you are using the Site unlawfully or in breach of these Terms, we may limit, suspend or end your access.
Accounts
You do not need an account to buy from us, but if you create one:
- You are responsible for keeping your login details secure and for activity that takes place through your account
- You agree to give us accurate information and to keep it up to date
You can close your account at any time by contacting us. We may suspend or close an account that is being used unlawfully or in breach of these Terms.
What we sell
We sell ebooks, audiobooks, paperbacks, special and signed editions, and gift cards.
We take care to describe and photograph our products accurately. Please note that screen settings vary, so colours — particularly on sprayed edges, foil and cover finishes — may look slightly different in person, and our books are printed to order, so small variations between copies are normal. Our refund policy sets out what counts as a defect and what does not.
Nothing in this section affects the consumer guarantees you are entitled to by law, including the guarantee that goods will match their description.
Prices, currency, taxes and duties
Prices are shown in the currency selected for your region and include any applicable taxes shown at checkout. We may change prices at any time, but changes will not affect an order you have already placed.
For orders to the European Union and the United Kingdom, VAT is collected at checkout, so no further tax or handling charge should be payable on delivery. For other destinations, any import duties, taxes or customs charges are your responsibility and are not included in the price.
Orders
Your order is an offer to buy. A contract is formed when we send you an order confirmation or dispatch your goods, whichever comes first.
We may refuse, cancel or amend an order where a product is unavailable, where there has been a pricing or description error, where we suspect fraud, or where we are unable to deliver to your address. If we cancel an order you have already paid for, we will refund you in full.
Pre-orders
Some titles are available to pre-order before release.
- Payment is taken when you place your pre-order.
- Release dates are our best estimate and can move. If a release date changes significantly we will let you know by email.
- You may cancel a pre-order for a full refund at any time before it is dispatched or, for digital titles, before the download link is sent. Just email us.
- Digital pre-orders are delivered on release day. Printed pre-orders are sent to print on or shortly after release day, and normal printing and shipping times then apply.
Signed and personalised items
Signed and personalised items are made specially for you once you order them. Because of this:
- They cannot be cancelled or returned once personalisation has begun, except where the item is faulty or not as described.
- The EU right of withdrawal does not apply to goods that are made to your specification or clearly personalised.
- Signatures, inscriptions and hand-finished details are done by hand and will vary between copies. This is not a defect.
Please check the spelling of any personalisation carefully before you order, as we cannot change it afterwards.
Gift cards
Gift cards are valid for at least three years from the date of purchase, can be used on anything in the store, and cannot be exchanged for cash. No fees are charged for holding or using a gift card. If a gift card is lost, contact us and we will do what we can to help, but we cannot guarantee replacement.
Payment
We accept credit and debit cards, PayPal, Shop Pay, Apple Pay and Google Pay.
Payment is processed by our payment providers, not by us, and we do not see or store your card details. By submitting payment information you confirm that you are authorised to use the payment method.
We may cancel or reverse a transaction where we reasonably believe it is fraudulent or unlawful.
Delivery
Ebooks and audiobooks are delivered by BookFunnel, by email to the address you used at checkout, normally within a few minutes. If it has not arrived, check your spam folder, and your Promotions tab if you use Gmail.
Printed books are printed and shipped by Bookvault. Printing times are shown on each product page and are additional to shipping time.
Please give us a complete and accurate delivery address. We are not responsible for parcels delivered to the wrong place because the address given was wrong or incomplete.

Returns and refunds
We do not accept returns for change of mind. Digital products are final sale.
Separate rights apply if your book arrives damaged or defective, and consumers in the European Union have a statutory right of withdrawal on printed books. Both are set out in our refund policy, which forms part of these Terms.
Marketing emails and messages
We only send marketing to people who have asked for it. Buying from us does not sign you up.
You can join our mailing list at any time through the sign-up form on the Site or by ticking the box at checkout, and you can leave at any time using the unsubscribe link in any email. Opting out of marketing does not stop order-related emails such as confirmations and shipping notices.
Mobile message service
Our mobile message service (the "Service") is operated by Tamara Gill. Using the Service means you accept the terms in this section. We may change or withdraw the Service, or these terms, at any time.
By opting in you agree to receive recurring marketing SMS from us at the mobile number you gave, which may be sent using automated technology. Signing up is entirely voluntary and is never a condition of buying anything.
We do not charge for the Service, but your mobile provider may charge for messages and data. Message frequency varies.
To opt out, reply STOP to any message, or use the unsubscribe link where one is provided. You will get one confirmation message and then nothing further. If you are signed up to more than one of our message programs you will need to opt out of each separately.

We may change the number the Service sends from and will tell you if we do. Messages sent to an old number may not reach us. Carriers are not liable for delayed or undelivered messages. Please keep your number up to date with us, and sign up again if you change it.

Your consumer rights
Where the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), or consumer protection law in your own country, gives you rights that cannot be excluded, nothing in these Terms limits those rights. These Terms are to be read subject to that law, and where there is a conflict, that law prevails.
Limitation of liability
Nothing in these Terms excludes or limits our liability for anything that cannot lawfully be excluded, including under the consumer guarantees, or for death or personal injury caused by our negligence, or for fraud.
Subject to that, and to the extent the law allows:
- Where we are liable in connection with goods you have bought, our liability is limited, at our option, to replacing the goods or refunding what you paid for them.
- We are not liable for loss of profit, loss of business, or any indirect or consequential loss.
- We are not liable for the Site being unavailable, or for anything outside our reasonable control.
Indemnity
To the extent permitted by law, you agree to reimburse us for reasonable losses and costs we suffer as a direct result of your unlawful use of the Site, your breach of these Terms, or your infringement of anyone's intellectual property rights.
This does not apply to anything caused by our own breach, negligence, or failure to comply with the law, and it does not apply to a consumer acting in good faith.
Links to other sites
The Site may link to other websites. We have no control over them and are not responsible for their content or their handling of your information.
Governing law
These Terms are governed by the law of the State of South Australia, and the courts of South Australia have jurisdiction.
If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of the mandatory consumer law of the country you live in, and you may bring proceedings in your local courts.
Severability
If any part of these Terms is found to be invalid or unenforceable, that part will be treated as removed and the rest will continue to apply.
Changes to these Terms
We may update these Terms to reflect changes in the law or in how we operate. The effective date at the top will change when we do. The Terms that apply to your order are the ones in force at the time you place it.
